WEDDING PHOTOGRAPHY CONTRACT 2018
Congratulations and thank you for your interest in Tom Soper Photography. Selecting a photographer to tell the story of your wedding is probably one of the most important decisions you will have to make in the upcoming months. My aim is to tell the story of your day, ensuring you have a complete photographic record of your wedding to look back on in years to come. Documenting every aspect of your special day is a job I take very seriously, but I will make sure that the photography is fun and relaxed for you and your families.

The contract is between the photographer and the client as detailed below.
The Photographer: Tom Soper, 65 Victoria St, Bury St Edmunds, Suffolk IP33 3BD. Tel: 07544 944 121
Summary of Contract: The photographer is responsible for providing for the client a photographic service and products as detailed below. The client undertakes to engage the photographer for this coverage for the price as detailed below.
The Coverage: Coverage begins at the agreed time and is limited to a maximum 10 hours attendance. Attended time may include short breaks as well as travel between venues. Additional hours are by agreement and at the sole discretion of Tom Soper Photography. Charges of £50 an hour will apply outside the stated coverage times.
Payment Arrangements: The client will exchange an engagement shoot and the wedding shoots for 6 months full page adverts and 6 months half page adverts in Bounce Magazine. Cancellation of the wedding photography by the client will not result in any penalty for Tom Soper Photography. Cancellation of wedding shoot by the photographer will result in the photographer paying the full rate shown on the rate card for all advertising which has already gone to print, with the exception of the first two months full page advertising which will count as payment for the engagement shoot. Any additional payments for albums and other services are to be made when additional order is placed. Prices for orders placed over one year after the date of the wedding may be subject to change.
Copyright: The 1998 Copyright, Designs, and Patents Act assigns copyright to Tom Soper. English Copyright Law states that the copyright of photographs remains with the photographer. The photographer grants the Bride and Groom permission to make copies of the images under the following conditions. The images taken by the photographer are for personal use by the Bride and Groom and their friends and relatives. Selling, publication or any commercial use of the photographs is not allowed without prior written permission from the photographer. The Bride and Groom are not permitted to pass on images to any third party, such as suppliers, that will be used for marketing or advertising purposes without written consent from the photographer. Tom Soper Photography retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his work. If you do not wish for your images to appear on the Tom Soper blog, social media or supplier’s websites please notify Tom Soper in writing at the time of Booking.
Model Release: The Bride and Groom grant the photographer the irrevocable and unlimited consent to use the photographs for editorial, competition, advertising and any other purpose.
Exclusivity: Tom Soper Photography shall be the sole professional (still) photographer at the venues specified. We do positively encourage family, friends, and other guests to take photographs throughout the day, however the photographer must be given precedence over your guests in order to take the wedding photographs required. Tom Soper Photography cannot be held responsible for lack of wedding photos if guests taking their own photos of the Bride and Groom have interrupted the photographer’s work.
House Rules: Please note that photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed and others insist that photographers can only shoot from a specific location. In such circumstances the Bride and Groom agree to accept the technical limitations that may be imposed on the equipment used. It is advised that the Bride and Groom make themselves aware of the rules of the venue and if necessary negotiate with the personnel concerned.
Creative Licence: Tom Soper Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Our judgment on photographic style and the number of photographs taken shall be deemed correct. Tom Soper Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement, in the case of changes of weather and the availability and willingness of subjects. The number of images supplied will be a minimum of 350. The actual number provided will be carefully considered and determined by Tom Soper Photography. Only images that meet Tom Soper Photography's high creative standards will be provided. Images not supplied to the client are deleted from the systems at point of selection and are not stored in archive.
Image Size, Colour Style & Composition: All image sizes are approximate. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record digitally or in print the exact colour as seen by the human eye. There is no right to reject on the basis of style or composition.
Viewing: Final images are to be supplied in a 3-6 week period following the wedding ceremony. Images will be supplied on your own web page from where you, and those you invite, will be able to download them. A USB stick with all the images saved on it will also be sent to you in the post so that you have a safe, backed up, copy of the images.
Album Design: If you subsequently order albums, design and layout is completed by Tom Soper Photography. You will have the opportunity to preview your album design and make up to three changes to it before a change-fee is assessed. Additional changes are charged at £10 per individual change. Approval for design changes and requests after 6 months of the wedding date may lead to further charges. Please allow six to eight weeks for delivery once final album design has been approved.
Attendance: If the photographer is too ill or becomes injured and cannot supply the agreed wedding services, then liability is limited to a refund of any payments received and the photographer will make every effort to find a replacement photographer for you to book.
Indemnity: The photographer agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by the photographer to obtain any clearances for which he was responsible in respect of third party copyright works, trademarks, designs or other intellectual property. The photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the wedding. In all other cases the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
Limitation of Liability: In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Tom Soper Photography has working methods in place to prevent the loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the photographer’s control. In these circumstances, liability is limited to the return of fees paid or part thereof according to the percentage of images supplied.
Complaints Procedure: Any complaints should be made in writing within four weeks of the images being supplied to Tom Soper Photography. Complaints will be responded to within 48 hours.
Privacy: Tom Soper Photography will store your details on a private internal database. These details will not be made available to companies or individuals outside of Tom Soper Photography. The undersigned have read and understood the above contract and agree to the terms and conditions in their entirety.
